1. Professional Installation Terms
House of Cedar facilitates professional installation services through a network of reputable, independent landscaping contractors.
● Service Area: Installation is available strictly within a 200km radius of our wholesale facility at 53-D Observatory Ln, Richmond Hill, ON.
● Facilitation & Liability: House of Cedar acts as a facilitator only; all physical labour is performed by independent third-party contractors who maintain their own liability insurance and WSIB clearance. While House of Cedar facilitates third-party installers, it is the Customer’s right to request a copy of the installer’s active WSIB Clearance Certificate and proof of $2M Commercial General Liability insurance prior to the start of work. House of Cedar maintains a strict policy of only facilitating contractors who have provided proof of active coverage; however, the Customer agrees that the final contract for labour is between the Customer and the Installer.
● Limitation of Liability: To the maximum extent permitted by applicable law, the total liability of House of Cedar for any claim arising out of or relating to the products, delivery, or facilitated installation services—whether in contract, tort, or otherwise—shall not exceed the total amount paid by the Customer for the specific order giving rise to the claim.
● Constructor Status: The independent contractor performing the work is designated as the “Constructor” under Ontario law and assumes 100% liability for site safety and workmanship.
● Standard Pricing: Installation is billed at a variable rate of the product cost (typically 15% to 35%) and assumes “normal” digging conditions in clean soil.
2. Site Readiness, “Dry Run” Fees & Photo Requirement
To prevent project delays, the customer must ensure the site is fully prepared prior to the arrival of the crew.
● Pre-Arrival Photo Mandate: Customers are required to submit a “Site Ready” photo to info@houseofcedar.ca or via text to 647-300-5786 at least 2 hours before the scheduled arrival. This photo must show a clear, unobstructed path to the planting zone.
● Site Obstructions: The delivery and installation zone must be clear of vehicles, debris, pets, and construction equipment.
● The Installation “Dry Run” Fee: If a crew arrives and cannot perform the installation due to site obstructions, lack of utility locates, or unsafe terrain, a “Dry Run” fee equal to 100% of the delivery charge plus a $250 labour rescheduling fee will be applied immediately.
● Wait Time: If a driver or crew is delayed on-site due to unready conditions, a “Wait Time” fee of $125 per hour (billed in 30-minute increments) will apply.
3. Sub-Surface Obstructions & Utility Locates (Mandatory)
● Ontario One Call: It is the Customer’s mandatory responsibility to contact Ontario One Call (tel: 311) to have all underground utility lines marked prior to the arrival of the crew.
● Private Utilities: Customers must also identify and mark all private underground infrastructure (sprinklers, pool piping, landscape lighting). Neither House of Cedar nor the installer is liable for damage to unmarked lines.
● Change Orders: If sub-surface obstructions such as bedrock, buried concrete, or heavy clay are encountered, the installer reserves the right to decline service or issue a “Change Order” for additional labour and specialized equipment fees.
4. The House of Cedar Limited Health Warranty
We offer a 30-Day Limited Health Warranty on trees, plants and products, provided they are given the best start by our professional team.
● Eligibility Requirements:
1. Professional Start: The tree must be delivered and installed by a qualified member of the House of Cedar facilitated team.
2. Active Irrigation: A functional irrigation system must be present and active at the time of installation.
3. Standard Care: The customer must follow the “Tree and Plant Care Guide” provided at the time of installation.
4. Acceptance: Successful installation implies the customer accepts the product as healthy and assumes all further liability.
● Warranty Exclusions:
This warranty does not cover failure due to extreme weather or environmental conditions ● physical damage (animals/lawn equipment), documented neglect, or relocation by third parties.
Warranty does not apply to plant failure resulting from:
● improper watering (underwatering or overwatering)
● neglect or failure to maintain
● pest or disease issues
5. Zero Tolerance Policy
House of Cedar maintains a zero-tolerance policy regarding harassment or abusive actions toward our staff or sub-contractors. We reserve the right to automatically terminate all services without a refund in such cases.
